Injury Lawyer Thomas Kenny wins two dog bite cases

August 31, 2015

In September 2014, the Plaintiffs sued Mr. Kenny's clients who were boyfriend and girlfriend who owned a wonderful dog, a Rhodesian Ridgeback, a faithful friend. When along came the Plaintiff who claimed that he was bit by this wonderful dog.  The plainitff called the dog a pit bull and sued for up to $50,000 in Philadelphia county. Thomas Kenny, personal injury lawyer, accepted the case.

The case was complex the Plainitff claimed that the client's  were not physically capable of safely securing, maintaining or attending to the said dog; in failing to keep the dog safely confined, restrained, secured or muzzled so as to prevent the dog from roaming and attacking persons, especially Plaintiff; in failing to properly and adequately secure the dog in a safe and prudent manner so as to avoid dog bite incidents; in failing to properly restrain the dog; in having in their custody a vicious and ferocious dog, which Defendants herein knew or had reason to know, had such tendencies; failing to watch, supervise and attend the activities of the dog; failing to keep and maintain the dog in a safe place; violation of Pennsylvania's Dog Law, 3 P.S. Section 459 stating the clients were negligent in allowing and harboring a Dangerous Dog 3 P.S. Section 459-502A(a) and further guilty of a criminal act.

Mr. Kenny and his team went to work.  After many hours of investigation, it was determined that the Plaintiff had previously suffered from a debilitating eye injury and could not even identify the correct dog that bit him. Further, it was determined that the dog in fact came from somewhere other than Mr. Kenny's clients house.  In addition, the injuries claimed from the Plaintff did not match what he told medical personnel. Finally the police report was inconsistent with what the Plaintiff had reported.

On August 31, 2015, in the end, all the hard work paid off as the arbitration panel ruled in favor of Mr. Kenny's clients and against the Plaintiff.  Another great victory for justice and the firm.
